For the sake of easier readability, the usual male form of personal nouns and pronouns is used below. However, this does not imply a discrimination of the female sex, but should be understood as gender-neutral in the sense of linguistic simplification.

GWP assumes no liability whatsoever for the topicality, correctness, completeness or quality of the information provided. Liability claims against the GWP, relating to damages of a material or immaterial nature caused by the use or non-use of the information provided or by the use of incorrect and incomplete information are categorically denied, provided that there is no evidence of wilful intent or gross negligence on the part of the GWP. All offers are subject to change and are non-binding. GWP reserves the express right to change, amend, or delete sections of the pages or the entire offer without notice, or to cease publication temporarily or permanently.

In the case of direct and indirect references (hyperlinks) to third-party Internet pages or other documents on the Internet the GWP is not responsible for, the GWP can only be held liable if it was aware of the content of the website or if it would have been reasonable and technically feasible to prevent the use of websites with illegal content. The GWP explicitly declares that no illegal content could be identified on the linked websites at the time they were linked. 3. Copyright and trademark rights

The GWP endeavors to respect the copyright of all graphics, sound files, video sequences and text, to use their own graphics, sound files, video sequences and text, or to use license-free graphics, sound files, video sequences and text. All brand names and trademarks mentioned on the website, including those protected by third parties, are fully subject to the provisions of the applicable trademark law and to the ownership rights of the respective registered owners. A mere mention does not imply that trademarks are not protected by third party rights!

The copyright for our own published items will remain in our possession. Duplication or use of such graphics, sound documents, video sequences and texts in other electronic or printed publications is not permitted without the express consent of GWP.

4. Collection and recording of data

4.1 Safety

We take all necessary security measures on a technical and organisational level to store your personal data in such a way that it is neither accessible to third parties nor to the public. Nevertheless,Internet-based data transmissions can have security gaps, so that absolute protection cannot be guaranteed. Our employees are obliged to maintain confidentiality.
If you would like to contact us by email, we would like to point out to you that, in the case of this form of communication, the confidentiality of the information you provide in this way cannot be completely guaranteed. We therefore recommend that you exclusively send us confidential information by post.

We use the most common SSL (Secure Socket Layer) method together with the highest level of encryption supported by your browser. Usually, this is a 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. Whether a single page of our website is transmitted in encrypted form is indicated by the closed representation of the key or lock symbol in the lower status bar of your browser.

4.2 Visiting the Website

Each visit to our website is recorded in a log file to ensure data security. The following data is stored for a maximum of 24 hours:

  • Name of the file requested
  • Date and time or timestamp of the retrieval of each retrieved page
  • Queried resource
  • Origin of the page request
  • Name and version of the browser software

  • Indication whether query was successful
  • IP address of the user or the provider

A direct reference from the IP address to your person is not possible and is excluded.

The IP address is only evaluated in the case of attacks on our website, in the case of infringements of good morals or if the Internet offer is used for other illegal acts. A connection of the IP address to your person is only possible through your Internet provider in the case of a police or prosecutor’s investigation.

These data are not used for statistical purposes. We do not pass on this data to third parties either for commercial or for non-commercial use.

4.3 Member administration

As part of the membership administration, we collect the following personal data of the contact person and other named contact persons:

  • Form of address, title, first name, last name
  • Company
  • Department
  • Address, if necessary additional billing address (if different)
  • Telephone number (landline and/or mobile)
  • Fax number
  • Email address
  • Homepage
  • Date of entry, date of departure,
  • Type of membership, amount of membership fee,
  • Assignment to member categories
  • Logos, photos, video material

This data is collected,

  • to identify members,
  • for the fulfillment of mutual obligations arising from the membership,
  • from the correspondence,
  • for invoicing and financial accounting
  • to assert and to defend any claims arising from the membership.

Upon an expressly written and legally binding application of the respective member, the following data of the applying member in the member administration can be called up by each user of the GWP website and displayed:

  • Form of address, title, first name, last name
  • Company
  • Department
  • Business enterprise sector
  • Address
  • Telephone number (landline and/or mobile)
  • Fax number
  • Email address
  • Homepage (company profiles, reference projects) *
  • Logos, photos, video material

This application must have been received by the GWP prior to the granting of such access and approved by the GWP. The approval can also be concluded by activating the access to the data of the requesting member.

The application may be revoked at any time by the member. Access is terminated immediately, but no later than 2 working days after receipt of the written revocation at the GWP.

* Note on the membership list or on the company profiles and reference projects

The member directory represents a marketing offer by GWP to its members. Each GWP member has a profile under the directory that provides information about the company. The publication of reference projects is done on the one hand on the company profiles, on the other hand on the committees (regional forums and working groups). All information – in the context of the company profiles and reference projects – is provided by the members themselves (Art. 6 para. 1 DSGVO). They are publicly accessible via the website and can be viewed without restrictions. The responsibility for the accuracy of the information lies exclusively with the members. GWP assumes no liability for incorrect data.

By providing information in the membership directory, members also agree that they will be used by GWP for its internal work (e.g. for the production of competence atlases or the Index of Members). Disclosure to processors such as printing companies, agencies, IT service providers or similar service providers is only for the purpose of work in the interests of the members.

4.4 Email newsletters (member information) as well as other mailings to German Water Partnership members

As a result of being a member of the German Water Partnership you will be informed periodically about the activities of the German Water Partnership and its members as well as other news in the field of water management.

For sending the member information and other mailings, we use the following personal data

This data is collected,

  • to identify you as a recipient of our member information/mailings,
  • to send the member information/mailings,
  • to assert and to defend any claims arising from the membership.

4.5 Input of personal data in forms

Within the website some information offers the possibility to enter personal data, for example to register for events or access to the internal member area of the homepage.

It is your choice whether to enter this information. Only those data are required that are necessary for the desired purpose. We treat these data as confidential and only use them for the purposes for which they were requested.

4.6 General contact requests

If you send us a general contact request by email, letter, telephone or fax, the data you provide will be used for the correspondence with you.

Communication via email carries the risk of gaps in security. Emails can be stopped and viewed on the way to the employees of German Water Partnership by savvy Internet users. If we receive an email from you, we assume that we are entitled to respond by email. Otherwise, another type of communication would be considered, for example, by mail.

4.7 Cooperation with processors and third parties

If we disclose data to other persons and companies (processors or third parties) within the scope of our processing, transmit the data to them or otherwise grant them access to the data, this shall only take place on the basis of legal permission e.g. if a transmission of the data to third parties, such as payment service providers, is in accordance with Art. 6 para. 1 lit. b DSGVO to fulfill the contract. The data transmission takes place if a legal obligation stipulates this or it is based on our legitimate interests (e.g. the use of agents, webhosters, etc.). If we commission third parties with the processing of data on the basis of a so-called “order processing contract”, this is done on the basis of Art. 28 DSGVO.

4.8 Transmission to third countries

If we process data in a third-party country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if this occurs in the context of the use of third-party services or disclosure or transfer of data to third parties, this only takes place if it occurs for the fulfilment of our (pre)contractual obligations, on the basis of your consent, on the basis of a legal obligation, or on the basis of our legitimate interests. Subject to legal or contractual permissions, we process or leave the data in a third country only if the particular requirements of Art. 44 ff. GDPR are met.. This means, for example, processing is carried out on the basis of special guarantees, such as the officially recognised determination of a data protection level corresponding to the EU (e.g. for the USA by the “Privacy Shield”) or compliance with officially recognised special contractual obligations (called “standard contractual clauses”).

5. Cookies

The website can be visited in its entirety without the use of cookies. The following functions require cookies:

5.1 Statistical survey

On this website cookies are used, which allow an analysis of the surfing behavior of the users. This Web site uses the web analytics tool Analysis Tools “Google Analytics” (a web analytics service provided by Google Inc. (https://www.google.com/intl/en/about/) (1600 Amphitheater Parkway, Mountain View, CA 94043, USA ) for data collected and stored for statistical and optimization purposes. Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. For this purpose, the usage information generated by the cookie is transmitted to a Google server in the USA and stored there.

The processing of users’ personal data enables us to analyse the surfing behavior of our users. We are in a position to compile information about the use of the individual components of our website by evaluating the data obtained. This helps us to continuously improve our website and its user-friendliness. For these purposes, our legitimate interest also lies in the processing of personal data pursuant to Art. 6 para. 1 lit. f DSGVO. The information is used to evaluate the use of the website, to compile reports on advertising activities and to provide further services associated with the use of the website and of the Internet for the purposes of market research and demand-oriented design of these Internet pages. This information may also be transferred to third parties, provided this is legally required, or to the extent that such third parties process the information. Under no circumstances will your IP address be merged with other data from Google. The IP addresses are anonymised, so that an assignment is not possible (IP masking). By anonymizing the IP address, users’ interest in protecting their personal data is sufficiently taken into account.

When retrieving a web page, data about this process is stored. Specifically, the following information is available: page title, search term (where visitors come from), search engines, page URL, number of pages visited, location of the visitor (country), provider, browser, operating system, screen resolution, browser plugins, visit times, visit duration, entry pages, exit pages, downloads, referring websites.

When accessing our website, users are informed by an information banner on the use of cookies for analytical purposes and referred to this data protection declaration. A note is also included in this context as to how the user can disable the storage of cookies in the browser settings.

5.2 Opposition to data storage

You can set your browser so that you are informed about the use of cookies and decide individually on whether to accept them, or whether to deactivate the acceptance of cookies either in certain cases or completely. 5.3 Google maps integration

The German Water Partnership website uses Google Maps to visually display geographic information. When Google Maps is used, Google also collects, processes, and utilises data about the visitor’s use of map functions.

5.4 Google reCAPTCHA**

On this website we also use the reCAPTCHA function of Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”). This function is primarily used to distinguish whether an input is made by a natural person or is abused by machine and automated processing. The service includes the sending of the IP address and possibly other data required by Google for the reCAPTCHA service to Google and is carried out in accordance with Art. 6 (1) lit. f DSGVO on the basis of our legitimate interest in determining individual ownership on the Internet and the prevention of abuse and spam. The use of Google reCAPTCHA may also involve the transmission of personal data to the servers of Google LLC. in the USA.

Insofar as legally required, we have obtained your consent for the processing of your data as described above in accordance with Art. 6 Para. 1 lit. a DSGVO. 6. Legal basis and retention requirements

The legal basis for the processing of personal data for the purposes set out in Chapters 4 and 5 is Article 6 para. 1 lit. f DSGVO.

If it is necessary to store your personal data, your data will only be stored for as long as necessary to fulfill the purpose of the tick for which the data was collected. If the purpose is completed, the personal data will be irrevocably deleted after a maximum of 6 weeks, unless otherwise specified.

The personal data collected by us for the execution of the Contract will be stored until the expiry of the legal obligation to store them and then deleted, unless we have been obligated to longer storage in accordance with Article 6 para. 1 sentence 1 lit. c DSGVO due to tax and commercial law storage and documentation obligations (from HGB (German Commercial Code), StGB (German Penal Code) or AO (German Taxation Regulation)) we are legally bound to a longer storage period or you have given us your consent to store the data beyond that as stipulated according to Art. 6 para. 1 clause 1 letter a DSGVO.

7. Rights of the data subject

As users of the Internet offer made available by the  German Water Partnership, you have the following rights when processing personal data:

  • Right to information under Article 15 of the DSGVO The right of access gives you comprehensive insight into the data concerning you and some other important criteria, such as the processing purposes or the duration of the storage. The exceptions to this right regulated in § 34 BDSG apply.
  • Right to correction under Article 16 DSGVO The right to correction includes the possibility for you to have your personal data relating to you changed.
  • Right to cancellation under Article 17 DSGVO The right to delete includes the possibility for you to delete data. However, this is only possible if the personal data concerning an individual are no longer necessary, are processed illegally or if consent to this has been revoked. The exceptions to this right regulated in § 35 BDSG apply.
  • Right to restriction of processing according to Article 18 DSGVO The right to restriction of processing includes the possibility for you to prevent further processing of your personal data for the time being. A restriction occurs above all in the examination phase of other rights exercised by the person concerned.
  • Right to data portability according to Article 20 DSGVO The right to data portability includes the possibility for you to receive the personal data relating to you in a common, machine-readable format, for example as a PDF document, from the person responsible for transferring it to another person in charge if necessary to let.
  • Right to objection Article 21 DSGVO The right to objection includes the possibility for you to object in a particular situation to the further processing of your personal data, insofar as this is justified by the performance of public duties or public and private interests.
  • Right to withdrawal of consent according to Article 7 (3) DSGVO You have the right at any time to revoke your consent with effect for the future. A corresponding revocation option can be found in the respective Internet offer for which your consent was obtained.
  • Right to appeal under Article 77 DSGVOIf you believe that the processing of your personal data infringes the GSGVO, you have the right to complain to a supervisory authority, in particular your Member State, without prejudice to any other administrative or judicial remedy Whereabouts, your place of work or the place of alleged infringement.
